A Whitman, MA man was involved in a tragic, fatal incident today as the result of a sand avalanche.
The man was operating a front-end loader at the P.A. Landers sand and gravel worksite in Plymouth when sand unexpectedly covered the machine he was working on.
While this incident is still under investigation, there are numerous questions that arise when an accident such as this occurs. Was the worker properly trained? Was the equipment he was operating faulty? Was the operator using the machine according to instruction?
Unfortunately, construction industry and vehicular accidents top out as being the leading types of workplace incidents, accounting for more than 20% of worker deaths collectively.
If you or a loved one was recently injured or killed in a workplace accident, you are entitled to collecting compensation, regardless of who caused the accident. In the state of Massachusetts, workers and their families are supposed to be guaranteed benefits in accordance to workers’ compensation laws.
What Am I Entitled To?
Workers’ Compensation benefits typically include coverage of you or your spouse’s weekly earnings, up to 60% of average income, as well as coverage for any medical expenses related to the injury, compensation for permanent disfigurement or scars, vocational retraining if the injury prevents a worker from returning to his or her original job and death benefits to spouses of deceased workers.
When someone receives benefits through workers’ compensation, he or she is agreeing to not sue his or her employer. Issues may arise however when a worker or family member is not able to collect these promised benefits. Insurance companies have been known to interfere with this process, making it more challenging for workers to receive the compensation that they deserve.
